1. Scope of Services
The coach provides online coaching services to support the client’s personal and professional development. Services may include an intake call, scheduled coaching sessions, communication between sessions, and access to downloadable materials, depending on the chosen coaching package.
2. Nature of Coaching
Coaching is a professional service designed to facilitate personal and career growth. It is not therapy, medical care, or a substitute for mental health treatment. The coach is not a licensed healthcare provider and does not diagnose or treat medical or psychological conditions. The client remains fully responsible for their own wellbeing and decisions.
3. Booking & Scheduling
The intake session is scheduled by the client via the coach’s Calendly widget, available through the coach’s website. All subsequent coaching sessions are scheduled after the first session and planned by the coach based on the program's schedule. The full trajectory is planned in advance to ensure consistency and momentum.
4. Payment & Rescheduling
Payment is made via IBAN bank transfer, based on an invoice issued after the service agreement is signed.
As part of the 'Creative Reset' program, a satisfaction guarantee is offered. If, by the end of week 2, the client doesn't feel confident that the program will meaningfully improve their life, they may notify the coach in writing before the 3rd session. The coach will then schedule a brief call to discuss the client's experience, reasons, and feedback. After this call, the full payment will be refunded, and any scheduled sessions will be cancelled.
In general, sessions may be rescheduled if the client notifies the coach at least 24 hours in advance of the next session's start time. Missed sessions or cancellations with less than 24 hours’ notice are considered used, unless due to unexpected emergencies or technical issues as outlined in Section 5.
5. Technology Issues & Force Majeure
Coaching sessions are delivered online via Google Meet.
Internet Connectivity
If technical issues on the coach's end prevent a session from taking place, the session will be rescheduled. If technical issues on the client’s end prevent a session, the session will also be rescheduled. If such issues become a recurring pattern, the coach reserves the right to count affected sessions as used.
Force Majeure
In the event of illness, emergencies, or other unforeseeable events (e.g. natural disasters, power outages), both parties agree to communicate as soon as possible to reschedule affected sessions without penalty.
6. Client Responsibilities
The client understands that coaching is a collaborative and reflective process. Their active participation is essential to the impact of the sessions and the progress they make.
The client agrees to:
• Attend each session on time, in a suitable state to participate.
• Join from a quiet, private environment (no cafés, parks, or walking outdoors).
• Use a laptop or desktop computer for all coaching sessions (not a phone).
• Complete between-session exercises or assignments prior to the next session, if applicable.
• Communicate openly and respectfully with the coach, including not issuing commands, making inappropriate requests, recording sessions or using transcription tools without explicit permission.
• Take full ownership of their development, including implementing insights and decisions derived from the coaching process.
If the client feels uncertain, stuck, or needs clarification, they are encouraged to contact the coach between sessions for support.
7. Coach Responsibilities
The coach commits to:
• Offering their full presence, focus, and expertise during each session.
• Preparing adequately for sessions based on the client’s journey.
• Using relevant tools, methods, and techniques suitable for the coaching process.
• Clearly explaining their approach, intentions, and any potential outcomes.
• Supporting the client in co-creating a development plan aligned with their goals.
• Aiming to respond to emails or messages sent on LinkedIn within 24 hours during working days.
8. Intellectual Property
All coaching tools, exercises, and materials provided are the intellectual property of the coach and are intended solely for the client's personal use. They may not be reproduced, shared, or distributed without prior permission.
9. Data Protection (GDPR)
The coach complies with the GDPR (Regulation EU 2016/679). Personal data shared during the coaching process will be processed and stored securely. By entering into a coaching agreement, the client consents to the use and storage of their data as needed for the coaching process.
10. Legal Jurisdiction
These Terms & Conditions are governed by Dutch law. In the unlikely event of a dispute, both parties agree that any legal proceedings will fall under the jurisdiction of the Dutch courts.
